Last year, a factory worker in Sydney by the name of Brendan King was involved in a legal battle with his work colleagues over a $40 million Oz Powerball win. After many months of this ongoing back and forth legal battle, he has decided to move to the USA after being left with nothing more than a hefty legal bill of $1 million.
The legal battle involving Brendan and his colleagues started after his syndicate at work won $40 million on the Oz Powerball game. According to Brendan, he usually plays with the team in every draw but claimed that he was excluded from the draw which won them a whopping $40 million.
The Oz Powerball dispute landed up in court and a judge had to freeze the winnings until the matter could be settled. As a result, none of the winners have received any winnings for the duration of the legal battle which Brendan opened against them.
The problems continued for many months and last October, the Supreme Court in Australia had to finally decide on a judgement for Brendan King’s claims over the lottery win. The judge had ruled that it was right that Brendan was left out of the syndicate and ruled against him. That means Brendan doesn’t get a single cent of the winnings, and he has to pay a legal bill of $1 million.
After the tedious legal battle which deprived the winners of their winnings for over a year, the court didn’t just decide that he wasn’t entitled to his $2.7 million share. He was also ordered to pay the court costs for the 14 colleagues he inconvenienced as a result of the unnecessary lawsuit.
As you could imagine, this legal battle has put tremendous pressure on his finances and he admits, “I’ve got too many bills. Whatever happens, my family remains my biggest treasure. But I can’t pretend this hasn’t been a stress on us.”
Brendan King is a father to five children and he left Australia last month after being given a transfer from the electricity factory he worked at in Sydney to the factory in South Carolina, USA. “It got too much for Brendan, he’s a good guy, and he transferred with the company to Lexington two weeks ago and will be there for two years. It’s a fresh start in life for him and his family,” added one of his co-workers from his former plant. “It’s a fresh start in life for him and his family,” he added.
The 44-year-old has launched an appeal against the ruling and it will be held in the Court of Appeal in September. Because of that, a New South Wales Supreme Court hearing that was due to be held last month to set a final costs figure has been postponed. If Brendan doesn’t move to the USA, it will be much harder for his coworkers to enforce the cost order.
